Consumer Court Lawyer: complete guide
Introduction
Every consumer in India has the right to goods that are free from defects, services that are delivered as promised, honest advertising and fair treatment by sellers and service providers. When a car keeps breaking down, a builder delays possession of a flat for years, an insurer rejects a valid claim, a hospital is negligent, an airline cancels a flight without a refund, or an online seller refuses to replace a damaged product, the consumer can seek redress before a consumer commission without having to file a regular civil suit.
The Consumer Protection Act, 2019 governs these disputes. It replaced the Consumer Protection Act, 1986 and set up a three-tier system of Consumer Disputes Redressal Commissions: a District Commission in each district, a State Commission in each state and the National Commission in New Delhi. The Act also created the Central Consumer Protection Authority to act against unfair trade practices and misleading advertisements affecting consumers as a class, brought e-commerce transactions clearly within its scope, introduced product liability claims against manufacturers, sellers and service providers, and allowed complaints to be filed electronically.
Consumer commissions are designed to be simpler and quicker than civil courts. A consumer can file a complaint in person, without a lawyer, and the procedure is summary in nature. In practice, however, many complaints fail or get delayed because of avoidable problems: the complaint is filed before the wrong commission, the facts are not set out clearly, documents are missing, the relief claimed is not properly quantified, or the opposite party's objections on limitation or jurisdiction are not answered.
Professional help matters because a well-prepared complaint sets the tone for the whole case. Our consumer court lawyers draft legal notices, prepare complaints with the right evidence, file them before the correct commission, represent you at mediation and hearings, and handle appeals and execution of orders. This page explains who can file a consumer complaint, the legal requirements, the step-by-step process, documents needed, timelines, how fees work and what happens after an order.
Who Needs It
You may need a consumer court lawyer if you are:
- A buyer of defective goods, such as vehicles, electronics, appliances or furniture, where the seller or manufacturer refuses repair, replacement or refund.
- A home buyer facing delayed possession, poor construction quality or deviations from the promised plan by a builder.
- A policyholder whose insurance claim has been wrongly rejected, delayed or settled for less than due.
- A patient or family member affected by medical negligence or deficient hospital services.
- A bank or financial services customer facing wrongful charges, deficient services or unfair contract terms.
- A traveller affected by flight cancellations, lost baggage, deficient tour packages or hotel services.
- An online shopper dealing with fake products, non-delivery, refused returns or unfair terms imposed by sellers or platforms.
- A student or parent facing refusal to refund fees or deficient services by a coaching or educational service provider, subject to how commissions treat education matters.
- A subscriber to telecom, electricity, courier or other services facing deficient service, subject to any special remedy under the relevant law.
- A business facing a consumer complaint, which needs a defence on facts, jurisdiction and limitation.
A person who buys goods or avails services for resale or for a commercial purpose is generally not a consumer under the Act, but goods bought and used exclusively to earn a livelihood through self-employment are covered.
Key Benefits
- Correct choice of forum. The complaint is filed before the commission with the right pecuniary and territorial jurisdiction, avoiding dismissal or return.
- Well-drafted complaint. Facts, deficiency, unfair trade practice and relief are set out clearly, with documents arranged as evidence.
- Quantified relief. Claims for refund, replacement, compensation, interest and litigation costs are properly calculated and justified.
- Effective use of mediation. Where both sides agree, the matter can be referred to mediation, which can lead to a quicker settlement.
- Handling of technical objections. Lawyers respond to objections on whether you are a consumer, limitation, arbitration clauses and jurisdiction.
- Appeals and execution. If the order is challenged or not complied with, the lawyer handles appeals and execution proceedings.
- Less stress. You do not need to attend every hearing personally, and procedural steps are handled for you.
Consumer commission versus civil court. A consumer complaint is usually faster and cheaper than a civil suit, follows a summary procedure, and allows compensation for mental agony and harassment in appropriate cases. However, it is not suitable for every dispute. Matters needing detailed oral evidence or complex questions of title may be better suited to a civil court, and certain services, such as those rendered free of charge or under a contract of personal service, fall outside the Act. A lawyer helps you choose the right remedy.
Individual complaints and class action. An individual consumer can file a complaint for their own grievance. Where many consumers have the same interest, such as buyers in the same housing project, a complaint can be filed on behalf of all of them with the commission's permission. Separately, the Central Consumer Protection Authority can investigate and act against unfair trade practices, misleading advertisements and violations of consumer rights affecting the public at large, and consumers can bring such matters to its attention.
Eligibility and Legal Requirements
The main requirements under the Consumer Protection Act, 2019 and its rules are:
- Who can file. A consumer, a registered voluntary consumer association, the central or state government, the Central Consumer Protection Authority, one or more consumers with the same interest, or the legal heir or representative of a deceased consumer.
- Definition of consumer. A person who buys goods or hires or avails services for consideration, including online, but not for resale or commercial purposes, subject to the self-employment exception.
- Pecuniary jurisdiction. Under the rules notified in 2021, the District Commission hears complaints where the value of the goods or services paid as consideration does not exceed 50 lakh rupees, the State Commission where it exceeds 50 lakh rupees but does not exceed 2 crore rupees, and the National Commission where it exceeds 2 crore rupees. Jurisdiction is based on the consideration paid, not on the compensation claimed.
- Territorial jurisdiction. A complaint can be filed where the opposite party resides or carries on business, where the cause of action arose, or where the complainant resides or personally works for gain.
- Limitation. A complaint must be filed within two years from the date on which the cause of action arose. The commission can admit a later complaint if sufficient cause for the delay is shown and recorded.
- Filing. Complaints can be filed physically or electronically through the online consumer complaint filing system, with the prescribed fee, which depends on the value of consideration and is payable at actual.
- Reply timeline. The opposite party must file its version within 30 days of receiving the complaint, extendable by up to 15 days. The Supreme Court has held that this period cannot be extended beyond the total of 45 days.
- Decision timeline. The Act provides that a complaint should be decided within three months of notice where no testing of goods is needed, and within five months where testing is needed, though actual timelines often run longer.
- Appeals. An appeal from a District Commission lies to the State Commission within 45 days, and from the State Commission to the National Commission within 30 days. An appeal against an order directing payment requires deposit of fifty per cent of the amount ordered.
- Product liability. A claim can be made against a product manufacturer, product service provider or product seller for harm caused by a defective product or deficient service, under Chapter VI of the Act.
Consumer law rules and limits are amended from time to time. We check the current position at the time of filing.
Step-by-Step Guide
- Initial consultation. We listen to your grievance, review the purchase and correspondence, and assess whether it is a consumer dispute and the likely remedies.
- Checking limitation and jurisdiction. We confirm that the complaint is within two years and identify the correct commission based on consideration paid and location.
- Legal notice. Where useful, we send a legal notice to the seller or service provider setting out the deficiency and demanding a remedy within a reasonable time. Many disputes settle at this stage.
- Collecting evidence. We help you gather invoices, warranty cards, agreements, emails, chats, photographs, expert reports and proof of payments.
- Drafting the complaint. We prepare the complaint with a clear chronology, the deficiency or unfair trade practice alleged, the relief sought, and an affidavit and list of documents.
- Filing. The complaint is filed physically or online with the applicable fee, and copies are prepared for service on the opposite party.
- Admission. The commission considers admission, usually within the time allowed by the Act, and issues notice to the opposite party.
- Reply and rejoinder. The opposite party files its written version. We prepare a rejoinder and, where needed, evidence by affidavit.
- Mediation or hearing. If both sides agree, the matter is referred to the mediation cell. Otherwise, written arguments are filed and the matter is heard.
- Order and follow-up. Once the commission passes its order, we advise on compliance, appeal if required, or execution if the opposite party does not comply.

Pricing
Consumer court lawyer services begin with a consultation. After reviewing your matter, the lawyer provides a quote for the work involved. The quote depends on:
- The commission before which the complaint is filed
- The nature of the dispute, such as product defect, real estate, insurance or medical negligence
- Whether a legal notice, complaint, appeal or execution is needed
- The volume of documents and any expert evidence
- The expected number of hearings
The filing fee prescribed under the consumer protection rules depends on the value of the consideration and is payable at actual. Expert or testing charges, where needed, are also payable at actual.
Common Mistakes to Avoid
- Filing before the wrong commission. Jurisdiction is based on the consideration paid, not the compensation claimed. Calculating it wrongly can result in the complaint being returned.
- Waiting too long. The two-year limitation can expire while you continue informal follow-ups with the seller.
- Not keeping records. Without invoices, payment proof and written complaints, it is hard to prove the deficiency.
- Claiming unrealistic compensation. Inflated claims weaken credibility. Compensation should be linked to actual loss and harassment.
- Ignoring the reply deadline as a defendant. Businesses that do not reply within the 45-day outer limit can lose the right to file a defence.
- Missing hearings. A complaint can be dismissed for non-appearance.
- Not seeking interest and costs. Many complainants forget to claim interest on refunded amounts and litigation costs.
What Happens After
- Compliance by the opposite party. If the order is accepted, the opposite party must comply within the time set by the commission.
- Appeal. Either side may appeal within the time allowed, with the required deposit where payment is ordered.
- Execution. If the order is not complied with, the commission can enforce it as a decree, and non-compliance is punishable under the Act.
- Settlement. A settlement reached in mediation is recorded and treated as an order of the commission.
- Closure. Once the amount is received or the order is complied with, we ensure the matter is formally closed.
FAQs
Do I need a lawyer to file a consumer complaint?
No. You can file and argue your complaint yourself. However, a lawyer helps with drafting, jurisdiction, evidence and handling objections, which can make a significant difference in contested matters.
What is the time limit to file a consumer complaint?
Two years from the date the cause of action arose. A delayed complaint can be admitted only if the commission is satisfied that there was sufficient cause for the delay.
Which consumer commission should I approach?
It depends on the consideration you paid. The District Commission hears cases up to 50 lakh rupees, the State Commission above 50 lakh rupees and up to 2 crore rupees, and the National Commission above 2 crore rupees.
Can I file the complaint where I live?
Yes. The Act allows a complaint to be filed where the complainant resides or personally works for gain, in addition to where the opposite party is located or where the cause of action arose.
Can I file a consumer complaint online?
Yes. Complaints can be filed electronically through the online filing system for consumer commissions, with the fee paid online.
Is sending a legal notice compulsory?
No, but it is often useful. A notice puts your grievance on record and gives the opposite party a chance to resolve it, and many disputes are settled at this stage.
Can I file a complaint against an online marketplace?
Yes. E-commerce transactions are covered, and the Consumer Protection (E-Commerce) Rules, 2020 place duties on both sellers and platforms. Liability depends on the role each played in the transaction.
Can I claim compensation for mental agony?
Yes. Commissions can award compensation for loss, injury, mental agony and harassment in appropriate cases, along with refund, replacement, interest and costs.
Is a builder delay a consumer dispute?
Yes. Home buyers can approach a consumer commission for delayed possession or deficiency in construction. Remedies under the real estate regulation law may also be available, and a lawyer can help you choose.
Can a business be a consumer?
Generally, goods bought for resale or commercial purposes are excluded. However, goods or services used exclusively for earning a livelihood through self-employment are covered.
What happens if the opposite party does not comply with the order?
You can file an execution application. The commission can enforce the order and non-compliance can attract penalties and imprisonment under the Act.
Can the dispute be settled through mediation?
Yes. If both parties consent, the commission can refer the matter to its mediation cell, and a settlement reached there is recorded as an order.
Do consumer law rules change?
Yes. Pecuniary limits, fees and procedural rules have been revised in recent years. We check the current rules at the time of filing.
