Gender Change: complete guide
Introduction
Every person in India has the right to have their gender identity recognised in law. In National Legal Services Authority v. Union of India (2014), the Supreme Court held that gender identity is part of a person's dignity and personal autonomy, and that people have the right to self-identify their gender. Parliament then passed the Transgender Persons (Protection of Rights) Act, 2019, and the Central Government notified the Transgender Persons (Protection of Rights) Rules, 2020. Together, they set out how a transgender person can obtain an official certificate of identity and how a person who has undergone gender-affirming surgery can obtain a revised certificate showing their gender as male or female.
A certificate of identity is the foundation document. Once you have it, you can apply to change the gender and first name recorded in your birth certificate and in other official documents such as your Aadhaar, PAN, passport, voter ID, driving licence, bank accounts and educational records. Without it, each department may ask for different proofs, and records can end up showing different names and genders, which creates problems with banking, employment, travel and property.
The application to the District Magistrate is made online through the national portal for transgender persons, but the overall process is not a single step. You need an affidavit in the prescribed form, supporting identity documents, and, for a revised certificate after surgery, a certificate from the medical superintendent or chief medical officer of the hospital where the surgery was done. After that, the new name and gender usually need to be published in the official gazette and then updated, one by one, across your records. Our team helps you prepare the application and affidavit, guides you through the portal, and then handles the follow-on paperwork so your documents end up consistent.
We treat every case with confidentiality and respect. You decide what information is shared and with whom. The law itself protects your privacy: the Rules say that a medical examination is not required to obtain a certificate of identity as a transgender person.
This page explains who can apply, the legal requirements under the 2019 Act and 2020 Rules, the step-by-step process, the documents you will need, timelines, our fee, and what to update after your certificate is issued.
Who Needs It
Our gender change service is meant for:
- Transgender persons seeking a certificate of identity. This includes trans men, trans women, non-binary persons, genderqueer persons and persons with socio-cultural identities such as hijra, kinner, aravani and jogta, who want their identity recognised as transgender.
- Persons with intersex variations. The Act covers persons with intersex variations and allows them to apply for a certificate of identity.
- Persons who have undergone gender-affirming surgery. A person who has had surgery to change gender, either as male or female, can apply for a revised certificate, whether or not they earlier held a transgender certificate.
- Persons who need their records aligned. Many applicants already have the certificate but still have different names and genders on their Aadhaar, PAN, passport, bank records or degrees. We help bring these into line.
- Parents or guardians of minors. In the case of a child, the application is made by a parent or guardian, as provided in the Rules.
- Persons living or working abroad. Indian citizens abroad may need help preparing documents in India and updating their passport through the Indian mission.
If you only want to change your name without any change in gender, our name change service is more suitable.
Key Benefits
- Legal recognition of identity. A certificate issued by the District Magistrate is an official record of your gender identity that government departments are required to recognise.
- Basis for changing other records. The certificate is the key document used to change the gender and first name in your birth certificate and other official documents.
- Access to welfare measures. Many central and state welfare schemes for transgender persons require a certificate of identity or the related identity card.
- Protection against discrimination. The Act prohibits discrimination against transgender persons in education, employment, healthcare, housing, public services and access to public places. A certificate makes it easier to rely on these protections.
- Consistent documents. Matching records reduce problems in banking, property transactions, job applications, insurance claims and foreign travel.
- Confidential, guided process. Our team explains each step in advance, so you know what will be asked, who will see your information and how long each stage usually takes.
Certificate of identity and revised certificate: how they differ. The certificate of identity under Section 6 of the Act records a person as transgender. It is issued on the basis of self-perceived identity, supported by an affidavit, and no medical examination is needed. The revised certificate under Section 7 is for a person who has undergone surgery to change gender as male or female. That application must be supported by a certificate from the medical superintendent or chief medical officer of the medical institution where the surgery took place. A person holding a revised certificate can then update records to show male or female.
How the gazette fits in. The District Magistrate's certificate records your gender and, where applied for, your new name. Many departments, especially for passports, educational boards and central records, also expect a notification of the change of name and gender in the official gazette. We prepare the gazette application together with the certificate paperwork so the two documents match exactly.
Eligibility and Legal Requirements
Under the Transgender Persons (Protection of Rights) Act, 2019 and the Rules of 2020:
- Who can apply. Any transgender person, as defined in the Act, may apply to the District Magistrate for a certificate of identity. A person with intersex variations is also covered.
- Where to apply. The application is made to the District Magistrate of the district where the applicant has been ordinarily residing, through the national portal for transgender persons or in the manner the state allows.
- Application and affidavit. The application is made in the form prescribed by the Rules, along with an affidavit declaring the applicant's self-perceived gender identity.
- No medical examination. The Rules state that no medical or physical examination is required for issue of a certificate of identity as a transgender person.
- Minors. For a child, the application is made by a parent or guardian.
- Revised certificate after surgery. A person who undergoes surgery to change gender as male or female may apply for a revised certificate, with a certificate from the medical superintendent or chief medical officer of the medical institution where the surgery was performed.
- Time limit for decision. The Rules require the District Magistrate to process the application within a fixed period. Where an application is rejected, the applicant must be informed with reasons and has a right of appeal under the Rules.
- Identity card. Along with the certificate, an identity card is issued, which can be used as proof of identity.
- Change in official documents. Once a certificate is issued, the applicant is entitled to change the first name in the birth certificate and other official documents relating to their identity.
Each state and department follows its own procedure for updating records after the certificate is issued, and rules are amended from time to time. We check the current requirements at the time of filing.

Common Mistakes to Avoid
- Applying in the wrong district. The application must be made to the District Magistrate of the district where you ordinarily reside. Applying elsewhere leads to rejection or transfer.
- Different spellings of the new name. Use the exact same spelling in the affidavit, certificate, gazette and every later update. Even one letter of difference can cause problems.
- Skipping the gazette notification. Some departments accept only the certificate, but others, such as passport offices and educational boards, often ask for the gazette as well.
- Wrong order of updates. Update Aadhaar and PAN first, since many other records depend on them, and then move on to the passport, bank and educational records.
- Using an incorrect medical certificate. For a revised certificate, the medical certificate must come from the medical superintendent or chief medical officer of the institution where the surgery took place.
- Leaving old records active. Bank accounts, insurance policies and investments in the old name should be updated to avoid problems later with claims, nominations and transfers.
- Sharing more information than needed. You do not have to share medical details with every department. Share only what each process requires.
What Happens After
Once you have the certificate of identity or revised certificate:
- Download and keep copies. Keep the certificate, the identity card and the gazette notification safely, with several certified copies.
- Update Aadhaar. Change your name and gender in Aadhaar through an enrolment centre.
- Update PAN. Apply for correction of name and gender in your PAN records.
- Update your passport. Apply for re-issue with the new name and gender, using the certificate and gazette notification.
- Update voter ID and driving licence. Apply for correction with the election office and the transport authority.
- Update bank and financial records. Inform your banks, insurers, mutual fund registrars and employers, and update nominations.
- Update educational records. Apply to your school board and university for amended certificates, as each body has its own rules.
- Access schemes and protections. You can use your certificate to apply for welfare measures for transgender persons and to rely on the anti-discrimination protections in the Act.
We can assist with each of these updates as a follow-on service.
FAQs
Do I need surgery to get a certificate as a transgender person?
No. A certificate of identity as a transgender person is issued on the basis of self-perceived identity, supported by an affidavit. The Rules say no medical or physical examination is required for this certificate.
When do I need a medical certificate?
Only if you are applying for a revised certificate that records your gender as male or female after gender-affirming surgery. That application needs a certificate from the medical superintendent or chief medical officer of the hospital where the surgery was done.
Who issues the certificate?
The District Magistrate of the district where you ordinarily reside issues the certificate of identity and the identity card, through the national portal for transgender persons or the procedure followed in that state.
Can I change my name at the same time?
Yes. You can mention your chosen name in the application and affidavit. We also prepare the gazette notification so the name and gender change is recorded in the official gazette, which many departments ask for.
Is the gazette notification compulsory?
The law does not make it compulsory for every purpose, but many departments, including passport offices and educational boards, commonly ask for it. Having it makes updating records much easier.
Can a parent apply for a minor child?
Yes. The Rules allow a parent or guardian to make the application on behalf of a child. Additional care is taken in such cases, and we guide parents through the process.
What if my application is rejected?
The District Magistrate must give reasons for a rejection. You can file an appeal before the appellate authority within the time allowed under the Rules. We help you understand the reasons and prepare the appeal or a fresh application.
Will my information be kept private?
We treat everything you share as confidential and use it only for your application. The portal and official records follow their own privacy rules. You do not need to share medical details where the process does not require them.
Can I apply if I live abroad?
The application is made to the District Magistrate of the district of ordinary residence in India. If you have moved abroad, we review your situation and advise on how to proceed, including updating your passport through the Indian mission.
Do I have to change all my documents at once?
No, but it is advisable to update all key records soon after the certificate is issued. Mismatched records can cause problems with banking, employment checks, travel and property dealings.
Can I change my gender in my school or college certificates?
The Act entitles you to change the first name in your birth certificate and other official documents relating to your identity. Educational boards and universities each have their own procedures, so the process and timing differ. We guide you on what each body asks for.
Does the certificate affect my rights to property or inheritance?
A change in recorded gender does not take away your existing property rights. Questions about succession under personal law can be more complex, and we suggest a separate consultation if you have specific concerns.
What protections does the Act give me at work?
The Act prohibits discrimination against transgender persons in employment, including in recruitment and promotion, and requires certain establishments to designate a complaint officer and follow equal opportunity policies. You can raise complaints under these provisions.
How long is the certificate valid?
The certificate of identity is not a time-limited document. If you later undergo gender-affirming surgery, you can apply for a revised certificate showing your gender as male or female.
