Provident Fund (PF) Registration
Mandatory EPFO registration for organisations with 20 or more employees
Provident Fund (PF) Registration under the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 is mandatory for organisations employing 20 or more persons. Once registered, the employer must deduct 12% of basic wages from employees and contribute an equal amount. This provides retirement savings and social security to employees.
Provident Fund (PF) Registration: complete guide
Introduction
The Employees' Provident Fund is India's main retirement savings scheme for workers in the organised sector. Every month, both the employer and the employee contribute a fixed percentage of the employee's wages to a provident fund account. The money earns interest declared each year, and the employee can withdraw it on retirement, on leaving employment for a long period, or for specified purposes such as housing, medical treatment, education and marriage. Alongside the provident fund, the same contributions also fund a pension under the Employees' Pension Scheme and a life insurance cover under the Employees' Deposit Linked Insurance Scheme.
The scheme has long been governed by the Employees' Provident Funds and Miscellaneous Provisions Act, 1952, together with the Employees' Provident Funds Scheme, 1952, the Employees' Pension Scheme, 1995 and the Employees' Deposit Linked Insurance Scheme, 1976. The Code on Social Security, 2020, which consolidates this Act and other social security laws, has now been brought into force by the Central Government, with the existing provident fund schemes continuing under it while the rules and transition arrangements are being finalised. The scheme is administered by the Employees' Provident Fund Organisation, known as EPFO, through regional offices across the country.
PF registration is the process by which an employer's establishment is brought under coverage and given an establishment code. Once registered, the employer must enrol eligible employees, generate a Universal Account Number for each of them, deduct the employee share from wages, add the employer share, and deposit the total every month through an electronic challan cum return. Coverage is not optional for an establishment that meets the conditions in the law. Failure to register and contribute can lead to recovery of all past dues with interest, damages that can be substantial, and prosecution in serious cases.
Registration is done online through the unified employer portal, but the details entered at this stage, such as the date of coverage, the nature of the establishment, the number of employees and the identity of the employer, have lasting effects. An incorrect date of coverage, for example, can lead to a demand for several years of back contributions. Our team reviews your establishment, confirms whether and from when coverage applies, files the registration, helps you set up your employer login, and guides you through enrolling employees and filing the first monthly return. This page explains who needs PF registration, the legal requirements, the process, documents, timelines, our fee and what you must do after registration.
Who Needs It
PF registration is required for:
- Establishments with twenty or more employees. Factories engaged in any industry listed in the schedule to the law, and other establishments or classes of establishments notified by the Central Government, must register once they employ twenty or more persons. The notified list now covers a very wide range, including shops, offices, hotels, restaurants, schools, hospitals, IT and software firms, transport operators and many others.
- Employers counting contract staff. Workers employed through contractors in connection with the work of the establishment are generally counted when determining coverage, and the principal employer can be held responsible if the contractor does not pay.
- Businesses that have grown past the threshold. Coverage applies from the date on which the establishment first employs twenty persons, not from the date it applies. Growing businesses should register as soon as they reach this number.
- Establishments that want voluntary coverage. An establishment with fewer than twenty employees can be brought under coverage voluntarily if the employer and the majority of employees agree and apply to the Central Provident Fund Commissioner. Many startups and small businesses choose this so that employees can enjoy provident fund benefits.
- Multi-location businesses. A business with branches or departments in different places is generally treated as one establishment, and the employees of all locations are counted together for coverage.
Once an establishment is covered, it remains covered even if the number of employees later falls below twenty. Coverage applies to every type of employer, including proprietorships, partnership firms, LLPs, companies, trusts, societies and cooperatives.
Key Benefits
- Legal compliance. Registration meets a statutory requirement and protects the business and its responsible officers from recovery proceedings, damages, interest and prosecution.
- Retirement savings for employees. Employees build a retirement fund through regular contributions with interest, which improves financial security and staff loyalty.
- Pension and insurance cover. The Employees' Pension Scheme provides a monthly pension on retirement, disability or death, and the deposit linked insurance scheme provides a life insurance benefit to the family if a member dies in service.
- Portability with UAN. Each employee gets a Universal Account Number that stays with them throughout their career. When they change jobs, their account can be transferred online to the new employer.
- Tax benefits. Employer contributions within the limits in the law are deductible as a business expense when deposited on time. Employees' contributions qualify for deduction under the old tax regime, and withdrawals after continuous service for the required period are generally tax free.
- Attracting talent. Provident fund is part of a standard employment package in India, and many candidates expect it. Registration helps you hire and retain staff.
- Smoother tenders and audits. Government departments, large clients and lenders often ask for PF registration and payment records as part of vendor checks and due diligence.
How contributions work in practice. The employee contributes twelve percent of basic wages, dearness allowance and retaining allowance, which is deducted from salary. The employer contributes a matching twelve percent. Of the employer's share, eight point three three percent of wages, calculated on wages up to the statutory wage ceiling of fifteen thousand rupees a month, goes to the pension scheme, and the balance goes to the employee's provident fund account. The employer also pays a contribution for the insurance scheme and administrative charges at the rates notified from time to time. Some establishments, such as those with fewer than twenty employees or certain sick or notified industries, may be allowed a reduced rate of ten percent. Employees whose wages exceed the wage ceiling at the time of joining can be excluded from mandatory membership in some cases, but many employers choose to cover them.
What counts as wages. The definition of basic wages for provident fund purposes has been the subject of court decisions and changes under the new labour code. Allowances that are paid universally to all employees may need to be included in wages for contribution purposes. We review your salary structure at the time of registration to reduce the risk of short payment.
Eligibility and Legal Requirements
The key legal requirements for PF registration are:
- Threshold. Coverage applies to factories in scheduled industries and to notified establishments employing twenty or more persons. Smaller establishments can opt in voluntarily.
- Date of coverage. Coverage applies from the date the establishment first employed twenty persons. The employer must apply for registration within the time allowed after coverage, generally one month.
- Online registration. Applications are made online through the employer registration facility on the unified portal for labour registrations. The application is verified using the PAN of the establishment and the Aadhaar of the employer or authorised signatory, and signed with a Digital Signature Certificate or Aadhaar-based e-sign.
- Establishment code. On approval, EPFO allots an establishment code, which is used for all future returns and payments.
- Enrolment of employees. Every eligible employee, including contract staff and those on probation, must be enrolled from the date of joining. A Universal Account Number must be generated or linked for each employee, with Aadhaar seeding and bank account details.
- Monthly contributions. Contributions for each month must be deposited by the fifteenth of the following month through the electronic challan cum return.
- Interest and damages. Late payment attracts interest under section 7Q of the 1952 Act and damages under section 14B, which increase with the length of the delay. Non-payment can lead to recovery proceedings and prosecution.
- Records and inspections. Employers must keep records of attendance, wages and contributions, and must allow inspection by enforcement officers.
- Exempted establishments. Large establishments may, with approval, run their own provident fund trust instead of contributing to EPFO, subject to the conditions for exemption.
The Code on Social Security, 2020 and the rules under it are changing several procedural points, including the definition of wages, the registration process and the treatment of certain workers. We check the current requirements at the time of filing so that your registration reflects the latest position.

- Document review and preparation: one to two working days.
- Online filing: usually completed on the same day the documents are finalised.
- Allotment of establishment code: in many cases the code is generated quickly after online submission, but some applications are reviewed by the regional office, which can take longer.
- Queries from the regional office: if the office asks for clarification, especially about the date of coverage, the timeline depends on how quickly the response is filed.
- Employer login and UAN setup: one to three working days after the code is issued, depending on digital signature registration and employee data.

Common Mistakes to Avoid
- Registering late. Coverage applies from the date you first employ twenty persons, not from the date you register. A late registration leads to a demand for back contributions with interest and damages.
- Ignoring contract staff. Workers engaged through contractors are generally counted for coverage, and the principal employer is responsible if the contractor fails to pay.
- Splitting the business to avoid coverage. Treating branches or related units as separate businesses to stay below twenty employees is usually disregarded by the authorities.
- Keeping basic pay artificially low. Structuring salaries so that most pay is in allowances can lead to a finding that contributions were short paid on the true wages.
- Missing new joiners. Every eligible employee must be enrolled from the date of joining, including those on probation or training where the law requires.
- Late monthly deposits. Contributions must be paid by the fifteenth of the following month. Delays attract interest and damages, and employer contributions paid late may not be allowed as an income tax deduction.
- Wrong employee details. Mismatches between Aadhaar, PAN, bank and UAN records cause problems for employees when they try to withdraw or transfer their funds.
- Not updating changes. Changes in address, ownership, directors or authorised signatory must be updated on the portal.
What Happens After
Once your establishment code is issued, provident fund compliance becomes part of your monthly payroll:
- Enrol every eligible employee from the date of joining and generate or link their Universal Account Number.
- Deduct and deposit contributions every month and file the electronic challan cum return by the fifteenth of the following month.
- Mark exits correctly. When an employee leaves, update the date of exit on the portal so that they can withdraw or transfer their funds.
- Approve KYC and transfer requests raised by employees, using the employer's digital signature.
- Keep records of attendance, wages, contributions and challans for inspection.
- Display required notices at the workplace, as required under the scheme.
- Respond to inspections and notices from EPFO, including any assessment of dues under section 7A of the 1952 Act.
- Track law changes. The Code on Social Security, 2020 and its rules may change wage definitions, rates or procedures, and payroll settings should be updated accordingly.
Our team can take care of monthly PF returns, employees' state insurance filings and professional tax for you, so your payroll compliance stays on track.
FAQs
Is PF registration mandatory for every business?
No. It is mandatory for factories in scheduled industries and notified establishments that employ twenty or more persons. Establishments with fewer employees can register voluntarily if the employer and a majority of employees agree.
Do contract workers count towards the twenty employee limit?
Generally, yes. Workers employed through a contractor in connection with the work of the establishment are counted, and the principal employer must ensure that contributions are paid for them.
What happens if my employee count falls below twenty later?
Once an establishment is covered, it continues to be covered even if the number of employees later falls below twenty. You must keep contributing for eligible employees.
What is the contribution rate?
Both employer and employee generally contribute twelve percent of basic wages, dearness allowance and retaining allowance. Part of the employer share goes to the pension scheme, calculated on wages up to the statutory ceiling. A reduced rate applies in certain notified cases.
Can employees earning above the wage ceiling be excluded?
Employees whose wages exceed the statutory ceiling at the time of joining, and who were not already members, can be treated as excluded employees in some cases. However, many employers cover them voluntarily. We advise on the right approach for your staff.
What is a UAN?
The Universal Account Number is a permanent number given to each provident fund member. It remains the same across jobs, and all their member accounts with different employers are linked to it.
What is the due date for depositing contributions?
Contributions for a month must be deposited by the fifteenth of the following month through the electronic challan cum return on the employer portal.
What are the penalties for late payment?
Late payment attracts simple interest under section 7Q and damages under section 14B of the 1952 Act, which increase with the length of delay. Persistent default can lead to recovery proceedings and prosecution.
Can a proprietor or partner be a PF member?
Generally, no. Proprietors and partners are owners, not employees, and are not covered as members. Directors drawing a salary may be covered in some cases depending on their role and terms of employment.
Has the Code on Social Security changed PF registration?
The Code on Social Security, 2020 consolidates the 1952 Act with other social security laws. The provident fund schemes continue under it, but some definitions and procedures are being updated through rules. We check the current position when we file.
Do I need a separate registration for each branch?
Usually not. Branches and departments of one establishment are treated as one establishment for coverage, and are generally registered under a single code, with sub-codes where required.
Can I register voluntarily with fewer than twenty employees?
Yes. If the employer and a majority of employees agree, the establishment can apply for voluntary coverage. Once covered, the establishment must follow all provisions of the scheme.
Is ESI registration the same as PF registration?
No. Employees' state insurance is a separate scheme covering medical and cash benefits, with its own threshold, wage limit and registration. Many establishments need both.
